To the extent permitted by law, in no event shall Electrolux be liable for any direct, indirect, consequential, punitive, special or incidental damages (including, without limitation, damages for loss of business, contract, revenue, data, information or business interruption) resulting from, arising out of or in connection with the use of, or inability to use the Site or the Materials or out of or in connection with these Terms, even if Electrolux has been advised of the possibility of such damages. Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent that the liability of Electrolux cannot be excluded but can be limited, Electrolux’s liability is limited to NZD100 or at the sole discretion of Electrolux, any other remedy specified in these Terms.
If Electrolux does not comply with its undertakings under these Terms, it may either correct the non-compliance or, at its option, terminate the agreement created by your acceptance of these Terms by prior notice, posted on the Site, to you. To the maximum extent permitted by law, this clause expresses your sole and exclusive remedy in relation to non-compliance by Electrolux.
